Terms of Service

1. Agreement to Terms#

By accessing or using Post a Magic ("Service"), operated by Post a Magic ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

We may update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility#

You must be at least 13 years old (or the minimum age required in your country) to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms.

3. Your Account#

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@postamagic.com if you suspect any unauthorised use of your account.

You may not share your account with others, create multiple accounts to circumvent usage limits, or transfer your account to any other person.

4. Threads Account Connection#

Post a Magic connects to your Threads account via the official Threads API (provided by Meta Platforms, Inc.). By connecting your Threads account, you:

• Authorise us to access your Threads profile, posts, analytics, and replies as permitted by the Threads API
• Authorise us to create and publish posts on your behalf at times you specify
• Acknowledge that your use of Threads through our Service remains subject to Meta's Threads Terms of Use

You may disconnect your Threads account at any time from the Settings page. We will immediately revoke our API access upon disconnection.

5. Acceptable Use#

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Post spam, misleading, or deceptive content on Threads
• Harass, abuse, or harm any person or group
• Distribute malware, viruses, or other harmful code
• Attempt to gain unauthorised access to our systems or other users' accounts
• Scrape, crawl, or extract data from the Service beyond what is permitted by the API
• Reverse engineer, decompile, or disassemble any part of the Service
• Resell or sublicense access to the Service without our written consent
• Circumvent or manipulate Threads' algorithms or platform policies

We reserve the right to suspend or terminate accounts that violate these rules, without notice and at our sole discretion.

6. AI-Generated Content#

Post a Magic uses AI to generate content suggestions, captions, and analytics insights. You acknowledge that:

• AI-generated suggestions are provided for informational purposes and may not always be accurate or appropriate
• You are solely responsible for reviewing and approving any content before it is published to Threads
• We do not guarantee the accuracy, quality, or fitness of AI-generated content for any particular purpose

7. Intellectual Property#

The Service and all its original content, features, and functionality are owned by Post a Magic and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Service without our express written permission.

You retain full ownership of the content you create and publish through the Service. By using the Service, you grant us a limited, non-exclusive licence to access and process your content solely as necessary to provide the Service.

8. Payments and Subscriptions#

Certain features of the Service may require a paid subscription. By subscribing, you agree to pay the applicable fees as described on our pricing page. All fees are:

• Billed in advance on a monthly or annual basis
• Non-refundable except as required by law or as explicitly stated in our refund policy
• Subject to change with 30 days' notice

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period and you will retain access until then.

9. Disclaimers#

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, error-free, or free of viruses. We are not responsible for any content posted to Threads via the Service, or for any actions taken by Meta/Threads in response to content you publish.

Post a Magic is an independent service and is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. or Threads.

10. Limitation of Liability#

To the fullest extent permitted by law, Post a Magic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use the Service.

Our total liability to you for any claim arising out of these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination#

You may stop using the Service and delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice.

Upon termination, your right to use the Service will immediately cease. Sections of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

12. Governing Law#

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction, as applicable.
